NOTE: Delaware does not require a pre-lien notice before filing a mechanic’s lien. The mechanic’s lien itself is called a “Statement of Lien”. Under 25 Del. C. Section 2712(a), the claim may be included in a lawsuit to foreclose the lien. In fact, the customary practice is to do just that. In other words, you file your lawsuit and claim of lien at the same time. For this reason, it is best to retain a construction lawyer do bring such a lawsuit. Accordingly, no pre-lien or mechanic’s lien forms are provided for Delaware.
